hinzkunst GbR, Raichbergstr. 24, 72072 Tübingen (hereinafter referred to as hinzkunst) apply to purchase requests submitted via our homepage www.hinzkunst.com for business relations between hinzkunst and the Buyer orders.

We expressly reserve the right to change our General Terms and Conditions at any time. Please be so kind to check our GTC before submitting your purchase request. These General Terms and Conditions for sales to ultimate customers, as amended at the time of the purchase request, shall be exclusively valid.

Conclusion of Contract

All offers presented at our Internet shop are subject to change without notice and are not binding. Minor deviations from our descriptions or illustrations are possible. If you offer to purchase an item at www.hinzkunst.com you will receive an acknowledgement of receipt by email. This acknowledgement does not constitute an acceptance of your offer.

A purchase agreement will be concluded only from dispatch of the goods or send you an order confirmation by email. The contract language will be English. The text of the contract will not be saved.

Reservation of Availability

The acceptance of your purchase request will be subject to the item's availability. Should the item not be available, hinzkunst will be free to withdraw its offer to sell or offer a subsequent delivery. Please be so kind to inform us by email if you accept this later delivery date. Of course any payments already effected by you will be refunded without.

Prices

Prices include the statutory value-added tax [VAT] of 19% for customers in EU-countries. Shipping costs will be charged separately and will be listed in the invoice as a separate item. The delivery address is decisive.
For customers outside the EU all prices are to be understood as net prices. The delivery address is decisive. Any value-added tax [VAT] payable in the recipient country in accordance with statutory provisions shall be paid as an additional amount upon receipt of the goods. Import duties, if any, shall also be paid by the Buyer upon receipt of the goods.

Reservation of Title

All goods will remain the property of hinzkunst until the complete payment of all receivables under the delivery agreement.

Instructions on withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

Please note: Customized productions – e.g. goods with individual engraving, imprint and / or special packaging – are generally excluded from any withdrawal or exchange.

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.


Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Warranty and Liability

As a subsequent performance, the Buyer may at his discretion require the elimination of the defect or the delivery of non-defective goods. We are, however, entitled to reject the type of subsequent performance chosen by the Buyer, if it is only possible at unreasonable costs, and the alternative form of subsequent performance does not involve substantial disadvantages for the Buyer. During the period of subsequent performance, any reduction of the purchase price or a rescission of contract by the Buyer shall be excluded. If the subsequent performance is carried out as a replacement delivery, the Buyer shall be obliged to return to siebensachen the goods delivered first. Any subsequent performance will not be effected until the receipt of these goods. Exceptions shall be subject to a special agreement. A subsequent improvement shall be deemed a failure with the second unsuccessful attempt, unless a different conclusion is appropriate in particular with regard to the nature of the goods or defect or in view of other circumstances. In case of a failed subsequent performance or a refusal of subsequent performance on our part, the Buyer will at his discretion be entitled to rescind the contract, to claim a corresponding reduction of the purchase price or to choose another available article.
